In plain words · सार
  • Our software, app and services are for lawful electoral and governance work in India only.
  • You must follow the Model Code of Conduct, election law and ECI instructions — we will not help anyone break them.
  • Campaign spending on our services belongs in the candidate's election-expenditure account.
  • AI output is a draft: you review it, label it where required, and never use it to impersonate anyone.
  • Your campaign data stays yours; we process it only to serve you and delete it when the engagement ends.
  • We help you read and reach the electorate — we do not and cannot guarantee any election result.

This summary helps you read the document; the full text below is what applies.

1. About these terms

These Terms & Conditions ("Terms") govern your use of the Algoanalytica website, the Brahmastra platform (including Brahmastra AI), the Brahmastra Survey mobile app, and the services we provide — surveys, speech writing, consultancy, guidance, and campaign, profile and governance design (together, the "Services"). "Algoanalytica", "we", "us" and "our" mean Algoanalytica, New Delhi, India. "You" means the person or organisation using the Services, including a candidate, political party, elected representative, campaign team, or anyone acting for them.

By using the Services, signing in, or signing a proposal or work order with us, you agree to these Terms. A signed proposal or work order may add specific terms; if it conflicts with these Terms, the signed document prevails for that engagement.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature.

2. Who may use the Services

  • You must be at least 18 years old and able to enter into a binding contract under the Indian Contract Act, 1872.
  • If you act for a party, candidate or organisation, you confirm you are authorised to bind them.
  • The Services are meant for use in India and for Indian elections and governance. You must not use them on behalf of a foreign source to influence an Indian election, or in any way that breaks Indian law.

3. Accounts and access

Brahmastra access is granted per account and scoped to the states, seats and, where applicable, polling parts you are given. You must:

  • keep your credentials confidential and not share accounts — each user needs their own login;
  • tell us promptly about any unauthorised use of your account;
  • not try to reach data, seats or parts outside your grant, or bypass, probe or test the platform's security;
  • not scrape, copy in bulk, resell or republish data from the platform, except as your engagement allows.

We may suspend an account that shows signs of misuse or compromise while we investigate.

4. Election law and ECI compliance

You are responsible for making sure that your campaign, and every use you make of the Services, complies with the Representation of the People Act, 1951, the Conduct of Election Rules, 1961, the Model Code of Conduct, and the instructions, advisories and guidelines of the Election Commission of India and the State Election Commissions in force at the time. In particular:

  • Expenditure — money spent on our Services for a candidate's campaign must be accounted for in the candidate's election-expenditure account as required by section 77 of the Representation of the People Act, 1951 and ECI instructions. We will issue proper invoices to support this.
  • Political advertisements — advertisements on television, radio, social media, websites, bulk SMS and voice messages must carry any pre-certification required by the Media Certification and Monitoring Committee (MCMC) under ECI instructions before they are published or sent.
  • Silence period — no election matter, including opinion-poll results, may be displayed or broadcast in the 48 hours before the close of poll, as section 126 of the Act provides; exit-poll results may not be published during the period barred by section 126A.
  • Corrupt practices — the Services must never be used for bribery, undue influence, intimidation, appeals on the ground of religion, race, caste, community or language, or false statements about a candidate's personal character or conduct (section 123 of the Act).
  • Government resources and official machinery must not be used for campaign work through the Services while the Model Code of Conduct is in force.

We may decline, pause or withdraw any work that we reasonably believe would break election law or ECI instructions, without liability to you.

5. Acceptable use

You must not use the Services to:

  • create or spread misinformation, fake news, hate speech, or content that promotes enmity between groups;
  • create deepfakes or any synthetic audio, image or video that depicts a real person saying or doing something they did not, without that person's documented consent;
  • impersonate any person, party, election official or government body;
  • harass, threaten or intimidate voters, candidates, election staff or anyone else;
  • send unsolicited commercial communication in breach of the Telecom Commercial Communications Customer Preference Regulations, 2018 (DND rules), or WhatsApp's business and commerce policies;
  • process personal data without a lawful basis under the Digital Personal Data Protection Act, 2023;
  • upload malware, or interfere with the platform's operation, other users, or our infrastructure.

6. Brahmastra AI and generated content

Brahmastra AI produces drafts — speeches, summaries, creative variants, reports — from the data you are entitled to see. AI output can be wrong or incomplete. Therefore:

  • every AI output is a draft for human review; you, and where we provide the service, our team, review it before it is used;
  • you are responsible for any content you publish or send, whether drafted by AI or by people;
  • synthetic or AI-generated content must be labelled as such wherever ECI advisories, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 or platform rules require it;
  • AI voice calls in a leader's voice are made only with that leader's written consent to the use of their voice, and only to recipients who may lawfully be called;
  • we do not use your campaign data to train AI models offered to other clients.

7. Electoral rolls and public election data

Brahmastra works with data published under law — electoral rolls, Form 20 booth results, and panchayat and municipal results published by the Election Commission of India, Chief Electoral Officers and State Election Commissions. You must use such data only for lawful electoral and governance purposes and in line with any conditions the publishing authority sets. You must not sell it, use it to harass or profile individuals beyond those purposes, or use it to deny anyone the right to vote.

Our processing (for example, reading roll PDFs into searchable records) can contain errors. The official published version always prevails.

8. The Brahmastra Survey app

The app is used by surveyors — our ground teams, or your agents with access you grant. Surveyors using the app agree that, while they are on an active survey assignment, the app records their location, the location of each submission, timestamps, and any photos or audio they capture, and checks submissions against the assigned geo-fence.

Surveyors must read out the consent statement before an interview, interview only adults who agree, capture a respondent's name, phone number or photo only with that respondent's consent, and stop if the respondent asks.

Survey results are for research and planning. Publishing opinion-poll results is subject to section 126 of the Representation of the People Act, 1951 and ECI instructions.

9. Your data and our role

Data you give us or collect through the Services for your campaign — voter-contact lists, survey responses, influencer records, notes — remains yours. For that data you are the Data Fiduciary and we act as your Data Processor under the Digital Personal Data Protection Act, 2023: we process it only on your instructions, to deliver the Services, and keep it confidential and secure.

You confirm that you have a lawful basis — such as consent given with a proper notice — for any personal data you give us or ask us to collect, and that you will handle requests from Data Principals about it. Our Privacy Policy explains how we handle personal data for which we are the Data Fiduciary.

When an engagement ends we return or delete your campaign data within 30 days of your written request, or as the work order says, except where the law requires us to keep it longer.

10. Intellectual property

Brahmastra, Brahmastra AI, the Brahmastra Survey app, our software, methods, dashboards, designs and the Algoanalytica and Brahmastra names and logos belong to us or our licensors. You receive a limited, non-exclusive, non-transferable right to use them during your engagement.

Deliverables made specifically for you — speeches, creatives, reports — become yours once paid for in full, unless the work order says otherwise. We may keep working copies for our records and may use anonymised, aggregated learnings to improve our methods, never your identifiable data.

11. Fees and payment

Fees, deliverables and timelines are set out in your proposal or work order. Fees are exclusive of GST and other applicable taxes, which are charged as per law. Unless agreed otherwise, invoices are payable within 15 days. We may pause work on overdue accounts after notice.

12. Confidentiality

Each side will keep the other's non-public information — strategy, data, pricing, plans — confidential, use it only for the engagement, and share it only with people who need it and are bound by similar duties. This continues after the engagement ends. It does not cover information that is public, already known, independently developed, or required to be disclosed by law or a lawful order.

13. No guarantee of results

Elections are decided by voters. We provide analysis, tools and services with reasonable skill and care, but we do not promise any vote share, margin or result. Examples, charts and figures on our website marked as illustrative are not real results. Beyond what these Terms or a signed work order expressly say, the Services are provided "as is" and "as available".

14. Liability and indemnity

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, opportunity, votes or reputation. Our total liability arising from an engagement is limited to the fees you paid us for that engagement in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.

You will indemnify us against claims, penalties and costs arising from your breach of these Terms, of election law, or of data-protection law, or from content you publish using the Services.

15. Suspension and termination

Either side may end an engagement as the work order provides. We may suspend or end access immediately if you materially breach these Terms, break the law using the Services, or if an authority lawfully directs us to. Sections on confidentiality, data, intellectual property, liability and disputes survive termination.

16. Governing law and disputes

These Terms are governed by the laws of India. The parties will first try to resolve any dispute by good-faith discussion for 30 days. If that fails, the dispute will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in New Delhi, in English. Subject to that, the courts at New Delhi, Delhi have exclusive jurisdiction.

Neither side is responsible for delay caused by events beyond its reasonable control, such as natural disasters, network or power failure, or orders of an authority.

17. Changes and contact

We may update these Terms. The date at the top shows when they last changed; material changes will be notified to active clients. Continued use after a change means you accept it.

Questions or complaints about these Terms: Grievance Officer, Algoanalytica, admin@algoanalytica.com, New Delhi, India. We acknowledge complaints within 24 hours and aim to resolve them within 15 days, in line with the IT Rules, 2021.
